Jointly in The Globe And Mail: Is there a prenup for parenting? The short answer is no

One of our founders, Amanda Baron, was featured in a recent article exploring how prenups fit into modern relationships and what role they do (and don’t) play when it comes to parenting.

As Amanda highlights, while prenups are becoming increasingly popular among young Canadians, they are fundamentally financial agreements. They can address property, debt, and spousal support, but they cannot create legally binding parenting or child support arrangements in advance. Instead, those decisions must always be made based on the best interests of the child at the time of separation.

What prenups can do, however, is just as important. Amanda explains that they can account for the financial realities of caregiving, include shared intentions around co-parenting, and, perhaps most importantly, reduce conflict if a separation occurs. By setting clear expectations around finances, couples create a roadmap that allows families to move forward more smoothly, without prolonged disputes.

It’s great to see this perspective highlighted. At Jointly, we believe prenups aren’t about planning for the worst—they’re about clarity, cooperation, and protecting families in a thoughtful, proactive way.
