Independent legal advice (ILA) means each partner reviews the finished agreement with their own lawyer before signing. It’s required in some provinces, recommended everywhere. Jointly’s partner lawyers make the review affordable and efficient.

Courts give real weight to agreements where both partners understood what they signed. ILA is the clearest evidence of that, and in Alberta, it’s required for your agreement to be enforceable.

Is independent legal advice required?
In Ontario and BC, ILA isn’t mandatory. It’s always recommended if you can afford it, because it strengthens your agreement. In Alberta, independent legal advice for each of you is required for property provisions to be enforceable under the Family Property Act.
How much does ILA cost?
Independent legal advice costs between $400 and $1,500 per person, depending on your needs. That’s far less than full drafting, because the lawyer is reviewing a finished document rather than writing one. Our partner lawyers list their flat fees up front in your account, so you know the cost before you book.
Can my partner and I use the same lawyer?
No, and that’s the point. Independent means each of you gets advice from a lawyer acting only for you. It protects you both, and it protects the agreement.
